All website designs, source code, graphics, templates, documentation, and other materials (collectively, “Deliverables”) created, developed, or provided by Sugar Pixels, Inc. in connection with your project remain our sole and exclusive property.
2.3 Limited License to Client
While your subscription is active and in good standing, we grant you a non-exclusive, non-transferable, royalty-free license to:

Use the Deliverables solely on the domain(s) or platform(s) for which they were created;

Modify the text and images contained within the Deliverables; and

Use the Deliverables for your internal business purposes only, in accordance with any usage limits set out in your service agreement or invoice.
If you wish to obtain a perpetual, buy-out license, please notify us and, upon our approval and receipt of the applicable one-time fee, we will convert your license to a perpetual, non-expired, non-transferable license under these same terms (except as otherwise agreed in writing).
2.4 Restrictions on Use
Except for the text and image modifications expressly permitted above, you agree not to, without our prior written consent:
a. Copy, reproduce, adapt, translate, or create derivative works of any other aspect of the Deliverables;
b. Distribute, sublicense, transfer, rent, lease, or lend any Deliverable (in whole or in part);
c. Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of any Deliverable; or
d. Remove, obscure, or alter any proprietary notices or labels on any Deliverable.
2.5 Remedies for Breach
Any unauthorized copying, transfer, distribution, or other misuse of our Deliverables (other than permitted text/image edits) constitutes a material breach of these Terms and may subject you to liability for damages, injunctive relief, or both.
3. User Accounts
To access certain features, you may need to create an account. You are responsible for keeping your login credentials confidential and for all activities under your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Payments & Billing
All payments for our services are billed either monthly or annually, depending on your chosen plan. Prices and features are subject to change at any time. Setup fees may apply. Failure to pay on time may result in service disruption or termination.
4.1 Free Domain Offer
Eligibility & Conditions
As part of select Sugar Pixels website plans, you qualify for one (1) complimentary domain registration, subject to the following terms:
- Price Cap – The domain registration fee must not exceed $15.00 USD at the time of enrollment.
- Availability Requirements – The domain must be immediately available for standard registration — not listed as premium, auction, or parked.
- Customer Responsibility – You must verify availability and pricing. If your chosen domain exceeds $15.00 USD or isn’t available for standard registration, Sugar Pixels will request a different domain that meets these criteria.
- Final Confirmation – Offer validity is conditional on successful registration. Sugar Pixels reserves the right to refuse or cancel domain registrations that violate these rules.
5. Refund Policy
We offer a 30-day money-back guarantee on eligible plans. After 30 days, all payments are non-refundable. Custom or one-time services (e.g., design packages, development work) are non-refundable unless otherwise stated in writing.
6. Service Availability
We strive to keep our services running smoothly but cannot guarantee 100% uptime. We may temporarily suspend access to our services for maintenance, upgrades, or unforeseen issues. We are not liable for any losses due to downtime.
7. Third-Party Tools & Links
Our site and services may contain links to third-party tools or websites. We are not responsible for the content or privacy practices of those third parties. Use them at your own risk.
8. Termination
We reserve the right to terminate or suspend your access to our services at any time, with or without cause. You may also cancel your account at any time, but refunds will be subject to our refund policy.
